Professional Will & Executors
What is a professional will?
A professional will for therapists is a legal and ethical document that details a therapist's plan for managing their practice in the event of incapacitation, retirement, or unexpected death. It safeguards patients, the practice, and colleagues by ensuring proper arrangements are in place during such circumstances.
What Is an Executor?
An executor is a designated individual responsible for carrying out the instructions outlined in a professional will. Their duties may include, but are not limited to:
Notifying clients in the event of my incapacitation or passing.
Coordinating access to client records for those who request a copy.
Managing and securely maintaining both physical and electronic administrative and client files until they reach the state-mandated retention period for destruction.
Who Are My Executors?
I have appointed two executors for my professional will. Jennifer Roberts is my primary executor, and Anna Cadamus is my secondary executor. Both have signed a Business Associate Agreement (BAA) (click here for more details).
Jennifer will take the lead in executing my professional will but may delegate certain responsibilities to Anna if needed. If Jennifer is unable to fulfill her duties, Anna has agreed to step in as the primary executor.
